GENERAL TERMS & CONDITIONS – SILK & SAND

These General Terms & Conditions apply to all reservations, quotations, bookings, and rental agreements between Silk & Sand (hereinafter: Lessor) and the person renting an apartment (hereinafter: Guest).

1. Definitions

Lessor:
Silk & Sand Apartments, located in Curaçao.

Guest:
The natural person who books/rents an apartment.

Fellow Guests / Traveling Companions:
Persons staying in the apartment together with the Guest.

2. Reservation & Payment

2.1 A reservation is only confirmed when:

• the booking form has been completed and signed,

• a copy of the main guest’s passport has been received,

• the deposit has been paid.

2.2 Payment schedule:

• Deposit: 50% of the total rental amount within 7 days after booking.

• Remaining balance + security deposit: no later than 60 days prior to arrival.

2.3 For bookings made within 4 weeks prior to arrival:
100% of the rental amount, including the security deposit, must be paid immediately.

2.4 Failure to pay on time entitles the Lessor to cancel the reservation.

3. Security Deposit

3.1 The security deposit is €300 or €400, depending on the apartment.
3.2 The deposit will be refunded within 7 days after departure, provided that:

• no damage has occurred,

• the apartment has been left tidy,

• there has been no excessive water and/or electricity consumption.

3.3 Any additional costs or damages will be deducted from the deposit.

4. Water & Electricity Consumption

4.1 A reasonable usage of water and electricity is included.
4.2 Meter readings are recorded at check-in and check-out.
Consumption exceeding the included allowance will be deducted from the deposit.

5. Cancellation Policy

5.1 Cancellations must be submitted in writing to: bookingen@silk-sand.com

5.2 Cancellation fees:

• Up to 60 days before arrival → refund of deposit minus €150 administration fee

• 60–30 days before arrival → deposit is non-refundable

• Within 30 days before arrival → full rental amount is non-refundable

5.3 We strongly recommend taking out travel and cancellation insurance.

6. Arrival, Stay & Departure

6.1 Check-in: from 4:00 PM
Check-out: before 11:00 AM

6.2 Early check-in or late check-out is subject to availability and may incur additional costs.

6.3 Guests will be personally welcomed by our local property manager in Curaçao.

6.4 Only registered guests are allowed to stay in the apartment.

7. Use of the Apartment

7.1 The following is not permitted:

• smoking inside the apartment,

• hosting parties or events,

• causing noise disturbance (quiet hours: 10:00 PM – 8:00 AM).

7.2 Pets are not allowed.
7.3 The apartment must be left in a clean and orderly condition.

8. Liability

8.1 The Lessor is not liable for:

• loss, theft, or damage to personal belongings,

• accidents, injuries, or bodily harm,

• interruptions in electricity, water supply, or internet.

8.2 The Guest is responsible for any damage caused by themselves or their fellow guests.

8.3 Participation in activities such as swimming, sports or excursions is at the Guest’s own risk.

9. Force Majeure

In the event of force majeure (including natural disasters, flight cancellations, power outages, or other unforeseen circumstances), the Lessor is not liable for compensation or reimbursement.

10. Privacy

Personal data will only be used for:

• processing the reservation,

• mandatory guest registration with the local authorities (Curaçao regulation).

Processing is carried out in accordance with GDPR (EU) and our privacy policy as stated on the website.

11. Governing Law

These terms are governed by Dutch law.
Any disputes will be submitted to the competent court in the Netherlands.
